The Polish model is a state monopoly on online casinos. Only one single operator has the right to offer internet casino games: Total Casino, the platform of the state-owned company Totalizator Sportowy, launched in December 2018. And that is not all. Article 89 of the Gambling Act establishes a separate administrative sanction: 100% of the winnings received — regardless of how much you staked. In other words, winnings from an illegal operator can be confiscated in full.

The key criterion is participation specifically from Polish territory. The place where a bank account was opened determines nothing on its own; the evidence consists of IP addresses, login dates and transaction history.

Tax and legality are two different questions

Here comes a confusion worth untangling separately, because it appears in many reviews.

For a Polish tax resident, winnings from an operator holding a permit in an EU or EEA country may fall under the personal income tax exemption (art. 21 ust. 1 pkt 6a ustawy o PIT). Winnings from operators outside the EU and EEA — for example, with Caribbean or Asian licences — do not qualify for the exemption and must be declared.

But it does not follow that playing with a Maltese operator is legal. The tax exemption and liability under Article 107 KKS are two independent regimes. Winnings can be exempt from PIT and at the same time be subject to the 100% administrative sanction under Article 89. This is exactly the case where «no tax to pay» does not mean «everything is fine».

The situation of a Ukrainian living in Poland

Now let us put the two jurisdictions together, because it is precisely at this intersection that most readers of this page find themselves.

A licensed Ukrainian operator does not accept zloty

The law obliges an operator holding a PlayCity licence to settle exclusively in hryvnia through a bank account. There is no account currency to choose from in principle — no zloty, no euro, no dollars. This is not a restriction of one particular casino but a requirement for the entire legal segment.

Add identification via Diia or BankID before the first bet, mandatory spending limits tied to declared income, and the 23% tax that the operator withholds as a tax agent. The system is designed for a person who is in Ukraine and has Ukrainian banking details.
